Terms of Service

1. What Eve does

Eve helps your team find business prospects, prepare outreach, run approved LinkedIn and advertising workflows, monitor replies, and measure results. You decide who to contact and approve the outreach Eve is allowed to run. Results are not guaranteed unless a specific written offer says otherwise.

2. Your account and responsibilities

You must be at least 18, give us accurate information, protect access to your account, and promptly tell us about unauthorized use. You are responsible for your workspace, connected accounts, prospect lists, instructions, approvals, and messages.

Use Eve only for lawful business outreach. Do not use it to spam, deceive, harass, impersonate others, violate privacy or intellectual-property rights, bypass provider limits, introduce malware, interfere with the service, or break applicable law or the rules of a connected service.

3. Your data and content

You keep ownership of the data, lists, instructions, branding, and other content you provide. You give us permission to host, process, transmit, and display that content only as needed to provide, secure, and improve Eve. You confirm that you have the rights and lawful basis needed for the data you provide and the outreach you ask us to perform.

As between you and us, you may use drafts and other output Eve creates for you. AI-assisted output can be inaccurate or similar to output created for someone else, so review it before use.

4. Customer publicity

If you create a workspace and submit billing information for a non-Enterprise plan, you give us a worldwide, non-exclusive, royalty-free license during your customer relationship to display your organization's name and unmodified logo on our website, customer lists, and sales materials solely to identify you as a Gigacatalyst customer. You confirm that you can grant this permission. We will not imply an endorsement or publish a quote or case study without separate permission.

This permission does not apply to Enterprise plans or where a signed order form says otherwise. You can also ask us to remove your logo by emailing support; we will stop new uses and remove digital uses within a reasonable time.

5. Plans, trials, and payment

Prices, plan limits, trial length, and billing dates are shown at checkout or in an order form. Subscriptions renew automatically until canceled. You can cancel through the billing portal, and cancellation takes effect at the end of the current paid period unless stated otherwise. Fees are non-refundable except where the law or a written offer requires otherwise, and you are responsible for applicable taxes.

A promotion, refund promise, or meeting guarantee applies only under the eligibility, timing, and request rules shown with that offer.

6. Connected services

Eve works with services such as LinkedIn, Unipile, Stripe, Slack, Google, Meta, and data providers. Those services have their own terms and can change or stop their products. Gigacatalyst is independent and is not endorsed by LinkedIn or those other providers. We are not responsible for a third-party service, its availability, or actions it takes on your account.

7. Our service and intellectual property

We own Eve and its software, design, and branding. These Terms give you a limited right to use the service while your account is active; they do not transfer our intellectual property. If you send feedback, we may use it without restriction or payment.

We may change the service, impose reasonable limits, or suspend access to protect customers, providers, or Gigacatalyst. We may terminate an account for a material breach, unlawful use, nonpayment, or security risk. You may stop using Eve at any time.

8. Disclaimers and liability

Eve is provided “as is” and “as available.” To the extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise uninterrupted service, particular outreach results, or that a connected account will never be limited by its provider.

To the extent permitted by law, neither side is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data. Gigacatalyst's total liability arising from Eve will not exceed the fees you paid us for Eve in the 12 months before the event giving rise to the claim. These limits do not apply where the law does not allow them.

9. Legal details

California law governs these Terms, without regard to conflict-of-law rules. Any dispute must be brought in the state or federal courts located in San Francisco County, California, and each side consents to those courts. If one part of these Terms is unenforceable, the rest remains in effect. A signed order form controls if it conflicts with these Terms.

We may update these Terms. If a change materially reduces your rights, we will give reasonable notice. Continued use after the effective date means you accept the updated Terms.
